The Personal Data that is collected and used by Crestone includes your name, contact information such as physical addresses, email addresses, and phone numbers; your social security number and other government-issued identification number; your IP address and geolocation data; account information regarding your accounts with us and our affiliates, such as your account numbers, account balances, account assets, account transactions, and account histories; account credentials such as login names and passwords; account and routing information regarding your personal bank account; your employment or occupation and related data including employer names, position, and compensation; and any information in any requests, error logs, or other materials you submit related to the Services.

We collect your Personal Data from information you submit to us directly. Your choice to submit Personal Data is completely voluntary, and by providing any Personal Data to us through the Services or otherwise, you are providing us your consent for us to use your Personal Data for the purposes described herein and as necessary for us to fulfill any obligations to you.

How We Use Your Personal Data

We process Personal Data to operate, improve, understand and personalize our business, including but not limited to the Services. We collect and use Personal Data for the following purposes:

  • To meet or fulfill the reason you provided the information to us.

  • To provide support and assistance for the Services.

  • To create and manage your account or other user profiles.

  • To make investments, wire transfers, and complete other transactions related to your accounts.

Also, we may receive a confirmation when you open an email from us, which helps us improve our Services. We may create aggregated, de-identified or anonymized data from the Personal Data we collect, including by removing information that makes the data personally identifiable to a particular user. We may use such aggregated, de-identified or anonymized data and share it with third parties for our lawful business purposes, including to analyze, build and improve the Services and promote our business, provided that we will not share such data in a manner that could identify you.

Sharing of Personal Data

We occasionally hire other companies to provide certain services on our behalf, such as handling the processing and delivery of mailings, providing customer support, monitoring or processing payment and investment transactions, providing software development and maintenance services for our Client Portal and digital app, or performing statistical analysis of our Services. We will only provide those companies access to the Personal Data they need to deliver the service, which includes your name and contact information, account names and information, and information related to your usage of the Services. They are required to maintain the confidentiality of your information and are prohibited from using that information for any other purpose. 

We may transfer your Personal Data to a successor entity or individual upon a merger, consolidation, or other reorganization or sale of substantially all assets of the applicable business, in which we participate. We may also transfer your Personal Data between different offices and affiliates of ours for internal management and administrative purposes.

We may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on us; (b) protect and defend our rights or property, including to the Services; or (c) act under exigent circumstances to protect the personal safety of users of the Services or the public.

Except as described above, we do not sell, rent, or lease user Personal Data to third parties.

Data Security and Retention

We seek to protect your Personal Data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of Personal Data and how we are processing that data. For example, the Services use industry-standard Secure Sockets Layer (SSL) technology to allow for the encryption of Personal Data you provide to us. You should also help protect your data by appropriately selecting and protecting your password and/or another sign-on mechanism; limiting access to your computer or device and browser or app; and signing off after you have finished accessing your account. We retain Personal Data about you for as long as we have a business or legal purpose to do so. If you are a client of ours, we will retain your Personal Data for as long as your relationship with us continues, and thereafter for such time as we deem appropriate for purposes of compliance with the books and records requirements of the securities laws. For Personal Data of parties that are not clients, we intend to retain your Personal Data for a reasonable time, not exceeding 24 months. In some cases, we retain Personal Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation. We may further retain information in an anonymous or aggregated form where that information would not identify you personally.

Personal Data collected may be stored and processed in the United States or any other country in which we or our affiliates, subsidiaries or agents maintain facilities, and by providing such Personal Data or using any of the Services, you consent to any such transfer of information outside of your country.

Personal Data of Children

We do not knowingly collect or solicit Personal Data about children under 13 years of age; if you are a child under the age of 13, please do not attempt to register for or otherwise use the Services or send us any Personal Data. If we learn we have collected Personal Data from a child under 13 years of age, we will delete that information promptly. In this section, we use the term “sell” as it is defined in the Cal. CPA. Over the past 12 months, we have not sold any Personal Data to third parties. We also do not sell the Personal Data of minors under 16 years of age.

Cal. CPA - We Will Not Discriminate Against You for Exercising Your Rights Under the Cal. CPA

We will not discriminate against you for exercising your rights under the Cal. CPA. We will not deny you our goods or services, charge you different prices or rates, or provide you a lower quality of goods and services if you exercise your rights under the Cal. CPA. However, we may offer different tiers of our services as allowed by applicable data privacy laws (including the Cal. CPA) with varying prices, rates or levels of quality of the goods or services you receive related to the value of Personal Data that we receive from you.

The types of Personal Data we have collected regarding consumers in the last 12 months are described above in the section titled “Personal Data Collected.” This information falls into the following categories of “personal information” as established by the Cal. CPA:

We will not discriminate against you for exercising your rights under the Ut. CPA. We will not deny you our goods or services, charge you different prices or rates, or provide you a lower quality of goods and services if you exercise your rights under the Ut. CPA, except as may be permitted by the Ut. CPA.

Virginia Resident Rights

If you are a Virginia resident, you have the rights set forth in this section pursuant to the Virginia Consumer Data Protection Act (the “Va. DCPA”). Please see the “Va. DCPA - Exercising Your Rights” subsection below for instructions regarding how to exercise these rights.

If there are any conflicts between this section and any other provision of this Privacy Policy (not including other provision that expressly applies to residents of other states), and if you are a Virginia resident and Va. DCPA applies, the portion that is more protective of Personal Data shall control to the extent of such conflict. Va. DCPA - Non-Applicability to Commercial/Business Context

The terms in this “Virginia Resident Rights” section are restricted to Virginia residents acting only in an individual or household context. This does not cover a natural person acting in a commercial or employment context.

Va. DCPA - Personal Data Sales Opt-Out and Opt-In

We do not currently sell your Personal Data, or engage in Targeted Advertising or Profiling using your Personal Data (within the meaning of the Va. DCPA).

Va. DCPA - Access

You have the right to request confirmation as to whether we are processing your Personal Data and to access that Personal Data. This includes the right to access such information in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance. 

Va. DCPA - Deletion

You have the right to request that we delete the Personal Data that we have collected about you.

Va. DCPA - Correction

You have the right to request that we correct any inaccuracies in the Personal Data that we maintain related to you, taking into account the nature of the Personal Data and the purposes of the processing of the personal information. 

Va. DCPA - Exercising Your Rights

To exercise the rights described above, you must send us a request that (1) provides sufficient information to allow us to verify that you are either the person about whom we have collected Personal Data or are an agent authorized by that person, including without limitation your name and email address, and (2) describes your request in sufficient detail to allow us to understand, evaluate and respond to it. Each request that meets both of these criteria will be considered a “Valid Request.” We may not respond to requests that do not meet these criteria. We will only use Personal Data provided in a Valid Request to verify your identity and complete your request. You do not need an account to submit a Valid Request.

We will work to respond to your Valid Request within 45 days of receipt, although we may extend this time to the extent permitted by the Va. DCPA. We will not charge you a fee for making a Valid Request twice per calendar year, although we may charge you a fee to the extent permitted by the Va. DCPA for the third or subsequent request in a calendar year or if requests are manifestly unfounded, excessive, or repetitive.

If we decline to take action on a request, you may also appeal this decision by the same methods, in which case you must provide adequate information to identify the declined request. We will respond to a valid appeal within 60 days of receipt.

California Resident Rights

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Data to third parties for such third parties’ direct marketing purposes; in order to submit such a request, please contact us at info@crestonecapital.com.

Nevada Resident Rights

If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties who intend to license or sell that Personal Data. Please note that we do not currently sell your Personal Data as sales are defined in Nevada Revised Statutes Chapter 603A.

INTERNATIONAL USE

We make no representations that this Privacy Policy is appropriate for locations outside of the United States, or whether access to the Services and/or the provision of information through the Services or otherwise from such locations is permitted. Those who choose to use the Services and/or provide us with information from such other locations do so on their own initiative and are responsible for compliance with applicable local laws. The Services are not directed at individuals in the European Union and we do not currently knowingly collect any personally identifiable information from individuals in the European Union.
